to clarify im talking about artificial only sections, not fly fishing only.

is it legal to use a trout magnet in these sections? a trout magnet is a simulated rubber jig. how are the rules interpretted? rules state it can be made of plastic, rubber, wood, or metal......no bait fish, or edible bait of any kind and no simulated eggs.

i will not be using them this year because i no longer spin fish, but i have used them in the past......i just want to clarify this between a freind.
 
No simulated eggs? Does that mean you can not use glow bugs to fish for stocked rainbows?
 
this is a confusing rule, there are many scented soft plastics out lately. (Burkely gulp commersials) I wonder if these are legal or illegal?
 
Here are the regulations with regard to what can and can't be used:

-Fishing may be done with artificial lures only constructed of metal, plastic, rubber, or wood, or with flies and streamers constructed of natural or synthetic materials. All such lures may be used with spinning or fly fishing gear.

-The use or possession of any natural bait, baitfish, fishbait, bait paste and similar substances, fish eggs (natural or molded) or any other edible, substance is prohibited.
Taking baitfish or fishbait is prohibited.

Scented artificials aren't banned from a DHALO section, unless it's a molded egg.
 
Here is the solution to Delayed Harvest questions, make them all fly fish only C & R. Sorry is I offended anyone who likes to hit those areas with spinning setups, but total fly fishing and all C&R is my dream come true for all the regulated streams in PA.
 
i agree with the fly fishing only part, but not c&r - delayed harvest is a pretty good solution, most of the streams they stock them into will not hold them over the summer, that is why they have to stock them......

Great solution, what exactly was the problem that it's solving?
 
always wading..... i like to spin fish every now & then with single -hook spinners. the dhalo sections allow this, you & me as fly fishermen can fish anywhere we want with no restrictions on tackle. i like to change up every now and then and fish the dhalo sections especially during march. i'd hate to see those streams become fly-only. just my observations. i don't want to start a long and drawn out thread on spin -vs- fly though.
 
I think that "fish eggs (natural or molded)" is meant to disallow actual eggs (duh) or the powerbait eggs.
 
Powerbait minnows / gulp minnows are legal in DHALO areas (and actually work better than the real thing!!)... I asked the local WCO. I like to fly fish the DHALO sections for the first few weeks and then go through them with gulp minnows after the fish really get tight mouthed. THey just can't resist the gulp!

That all depends on the region and stream. I know of a few DHALO sections in SEPA that can hold trout year round. It may not be the temps holding natural reproduction back. The fish can survive the temps but cant breed due to other things like, nitrate in headwaters, silt or poor substrate. There are many reasons for this but they dont have to make them DHALO just because the fish cant survive. They do it to provide angling opportunities later into the season for everyone.

I dont know about that. Alot of laws enforced by the PFBC are not black and white and are left to the WCO to decide of it fits the criteria. What im trying to say is be careful. Your WCO might allow it and thats great ;-) have fun. But another might think its illegal. Its always best just to call the WCO for that region and ask 🙂
 
I've heard the debate over gulp and other plastic artificials many times. But what it really boils down to is that the only thing banned in DHALO areas is live bait and egg imitation. So even if a WCO wanted to push his luck and fine you for using gulp, I'm almost positive it wouldn't hold up if you fought it.
 
that maybe true also. I dunno, i only use flies so i never think about it ;-) All im suggesting is that its never a bad idea to ask the WCO for any given region about anything your going to fish.

Forgot about those.... paste baits aren't allowed. Neither are food items. But man made lures made to look like natural baits are allowed without a doubt.
 
what happened to the "molded facsimile of fish bait, bait fish" part of the regulation.

I find it appauling that soft plastics and scented baits are allowed.

There goes the neighborhood!
 
I'm with Maurice on this....I don;t like the idea of scented soft plastics on these streams. They definitely changed the wording on the regs which used to state that molded facsimiles were specifically prohibited. This wording change in effect changed the law. I wonder if they did this procedurally correctly?

Here are the old rules:

Fishing may be done with artificial lures only constructed of metal, plastic, rubber, or wood or with flies or streamers constructed of natural or synthetic materials. Specifically prohibited are the use of molded facsimiles or replicas of insects, earthworms, fish eggs, fish or any invertebrate or vertebrate either singly or in combination with the other materials.

so you see where there might be some confusion since no one remembers the PAFBC announcing this change.
 
I asked the regional PFBC office last spring the question about scented baits. He told me if it is fit for human consumption you can not use it. I don't know about you but plastic and rubber are not something I want to eat no matter what it is scented with. But I also think if scented baits are allowed, then why can't you apply a scent to your lures or flies?
