This is true. Is the case in Susquehanna County still in court? That one is interesting and has massive legal implications to the power WCOs might have going forward.

You never fish rivers that have stocked trout in them?

Regardless, I think the ability to decline purchasing a trout stamp has way more to do with warm water anglers not wanting one than it does a fringe group of wild trout only anglers.

Just a good ol' fashion case of you can't please everyone.

I agree except that last part.

They could please more in this regard.
If a person declined the trout stamp, they should only legally be allowed to fish unstocked waters and C&R.

I see no reason why the fringe purists that fish only unstocked wild trout waters on a C&R basis should have to fund the stocking in the state.

The thing is, that it's possible for stocked trout to find their way from stocked trout water up into unstocked ClassA wild trout streams. Think Kettle Creek/Hammersley. So, it's very possible for stocked trout to be caught in unstocked water. The Trout Stamp covers you in that event.

So dropping like 1 percent of sales would raise it by 15 for everyone including the warm water crowd? Yeah doubtful, the PFBC has no interest in pissing off that many anglers.

They should just drop the requirements for those that don't fish stocked trout water and raise it to 30 or more and make the users fund it themselves.

The definition of fishing in PA:

"Fishing." The act of angling, or to catch, take, kill or remove or the attempt to catch, take, kill or remove from any lands within or waters within or bordering on this Commonwealth any fish by any means or method for any purpose whatsoever.

I think your straightened out/broken hook ruse may not work...

The landowner filed a federal lawsuit against the PFBC in September of 24. I haven’t heard anything since.

The case against him for using too many rods was thrown out.

It shouldn't have to. All trout can swim, I think we are all aware of that, but it shouldn't matter in unstocked trout waters. We know which ones aren't approved trout waters. They should be fair game to C&R fishing if you don't purchase the stamp.

I don't think they have any interest in changing it period. Im just spitballing like the rest of you.

Actually it might, a box full of flies with broken off hooks shows an attempt NOT to catch, take, kill or remove.

Perhaps the person just likes to see this fish dart out, rise and then go about it's business.

There was actually a famous fly fisherman if I remember that did this later in life, he just enjoyed the eat, not the catch. Lee Spencer.
